The Proportionality of the Punishment to the Crime


Abstract | الملخص

This study addressed an important issue which is the proportionality of the punishment to the crime. As a case study ،this paper has chosen the crime of terrorism. Therefore ،after giving a specific definition on terrorism ،it explains that terrorism is forbidden from the Islamic standpoint of the law on the account of the threat it posed to the community by way of bloodshed and hazard of innocent people. The attributes of terroristic crimes are applicable to those of banditry because it involves corruption ،murder and intimidation of innocent people. Moreover ،it creates distressing consequences on society ،individuals and nation. Hence ،the appropriate punishment for terrorism is what the judge chooses thus achieving the security of society.This research has concluded the punishment for terrorism commensurate with this crime ،because the death penalty embodies the concept of justice in the application of the punishment for terrorism ،and actual reward for this type of crime.
