The Direct Lawsuit Role in Protecting the Rights of the Obligees: A Study for the Legislations the United Arab Emirates


Abstract | الملخص

The legeslations of the UAE gives the obligee the right to directly sue in the name of his obligor for the debts that are due on others for the latter. Such an action is an exeption to the general rule which limits lawsuits in between the parties that have direct legal relationship. In such a lawsuit there is no condition for the bringing the debtor in the lawsuit as it is based on the law, which allows for such an action to be brought direcly against the debtor of the debtor. There are many positive effects for the direct lawsuits over other sorts of lawsuits that are mentioned in the Civil Transactions Law of the UAE 1985. Among these effects is that the obligor is not allowed to discharge of the right that is related to the lawsauit from the time of the lawsuit or the time notification. Moreover, the obligee would have the sole right to the claim, without his/her claim being subjected to dividion with other debtors in proportion to their claims.
